Dealer/Owner wants your money

CONTRACT: When I received the contract I found: 1. Owner was selling me a Honeywell Generator, model 7213 which is NOT the same as the Generac 7210, as Estimater and Contract writer, told me. It is the same as the next lower and less costly Generac model 7209. The 7210 comes with a transfer switch and costs about $5,400.00 to $5,600.00 The 7209 does NOT come with a transfer switch (it is bought separately). The Generac 7209 costs about $4999.00 THIS IS BAIT AND SWITCH AND THE CONTRACT SHOWS NO COST FOR THE HONEYWELL MODEL 7213. 2. Honeywell Generator, model 7213 does not come with a transfer switch, as explained above. The transfer switch is added in the contract without showing my cost. 3. BATTERY: The battery is an added item. It can be bought anywhere batteries of this size are sold. There is no brand of battery and no cost shown for the battery. Battery sells for $79.99 in many places. 4. PAD: GENPAD - Does not show if it is concrete, composite, or other. Does not show my cost. 5. Contract shows: “Provide trenching for Gas and Electrical”. Contract does not show my cost, does not show if the trenching will be filled in or how it will be filled in and Owner would not say. 6. I asked to have Owner to add in they will clean up after the work, as is standard in any contract, but Owner would not add it to the contract. 7. TOTAL COST: $25,049.00: I DID NOT PAY. There is no cost (at all) in the contract to justify this total cost. Owner’s policy is not to show any customer costs in his contracts, except the TOTAL COST! 8. Payment to be made as follows: $12,524.50 50% upon signing. $12,524.50 50% upon completion of all work. $12,524.50 50% upon signing is NOT in compliance with CSLB. CSLB requires contracts to charge customer for first deposit either $1,000 or 10% of the cost of the contract. I DID NOT PAY. Contract written in September 2020. Generator was not in stock and will not be in stock until December, according to Contract Writer. Owner would have $12,524.50 of my money, without doing anything, for three (3) months or more, as there is no guaranty they will be available in December. On hardware website it shows similar will be available in January 2021. THIS IS POCKETING MY MONEY FOR 3 or 4 MONTHS. When I asked Contract Writer to fill in the blanks with costs, and other CSLB compliant information, I received an email from Owner, that he is withdrawing his contract offer.
